Effective: 1 January 2026
These Terms & Conditions ("Terms") form a legally binding agreement between you ("User", "you") and SocioSMS ("SocioSMS", "we", "us"). By accessing or using the SocioSMS mobile application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Eligibility
You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use the Service. By creating an account you represent and warrant that the information you provide is accurate, that you have legal capacity to enter into this agreement, and that your use of the Service complies with all laws applicable to you.
2. Description of Service
SocioSMS provides temporary virtual phone numbers that may be used to receive one-time verification messages (OTPs / SMS codes) from third-party online services. SocioSMS is an aggregator: numbers are sourced from independent telecommunications providers and may be subject to availability, network conditions, and third-party limitations.
3. Acceptable Use
You agree NOT to use the Service to:
- Commit fraud, identity theft, money laundering, or any other unlawful act;
- Harass, stalk, threaten, defame, or impersonate any person or entity;
- Bypass account-security or anti-abuse systems of any third-party service in violation of that service's terms;
- Distribute spam, phishing content, malware, or any harmful or deceptive material;
- Violate sanctions, export controls, or any applicable telecommunications regulations;
- Resell, sublicense, scrape, or systematically extract numbers, codes, or other data from the Service.
We reserve the right, in our sole discretion, to suspend or terminate any account that we reasonably believe is engaged in prohibited conduct, with or without notice.
4. Third-Party Services & Trademarks
Logos, brand names, and service marks displayed in the Service (including but not limited to WhatsApp, Telegram, Google, Facebook, Instagram, TikTok, X, and others) are the property of their respective owners. SocioSMS is not affiliated with, endorsed by, or sponsored by any such third party. References are provided solely for identification of the platforms from which a user may choose to receive a verification code.
5. Wallet, Pricing & Refunds
The Service is operated on a prepaid wallet model. Prices are displayed in your local currency at the point of purchase and may change without notice. If a purchased number fails to receive a verification code within the activation window, the corresponding amount is automatically refunded to your wallet. Wallet balances are non-transferable, are not legal tender, and (except where required by law) are non-refundable to your original payment method.
6. No Guarantee of Delivery
Delivery of SMS messages depends on mobile networks, the sending service, and other factors outside our control. SocioSMS does not guarantee that any specific message will be delivered, that any number will work with a particular third-party platform, or that the Service will be uninterrupted or error-free.
7. Account Security
You are responsible for safeguarding your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use. SocioSMS will not be liable for any loss arising from your failure to comply with this obligation.
8. Suspension & Termination
We may suspend, restrict, or terminate your access to the Service at any time, with or without cause and with or without notice, including (without limitation) for suspected fraud, abuse, chargebacks, or breach of these Terms. Upon termination, your right to use the Service ceases immediately.
9. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory or otherwise, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.
10. Limitation of Liability
To the maximum extent permitted by law, SocioSMS, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or in connection with your use of the Service. Our total aggregate liability for any claim shall not exceed the greater of (a) the amount you paid to us in the three (3) months preceding the event giving rise to the claim, or (b) USD 50.
11. Indemnification
You agree to indemnify and hold harmless SocioSMS from any claim, demand, loss, or damages, including reasonable legal fees, arising out of your use of the Service, your violation of these Terms, or your violation of any right of a third party.
12. Changes to the Terms
We may revise these Terms at any time. Material changes will be notified through the app or by email. Continued use of the Service after the effective date of any revision constitutes acceptance of the updated Terms.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the jurisdiction in which SocioSMS is incorporated, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms shall be resolved exclusively by the competent courts of that jurisdiction, except where mandatory consumer-protection laws provide otherwise.
